Welcome to CMS Map & Store Locator ("the App", "our", "we", or "us"). The App is developed and operated by [Your Company / Developer Name] and is made available through the Wix App Market for use on websites built on the Wix and Wix Studio platforms.


By installing, integrating, or utilizing the App on your Wix website, you ("User", "you", or "Site Owner") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately uninstall and discontinue use of the App.


1. Description of the Service


CMS Map & Store Locator is a native custom element application designed for Wix sites. It connects website owners' Wix CMS (Content Management System) collections to dynamic, interactive maps rendered using open-source vector technologies (including MapLibre GL JS). The App displays markers, categories, details, and interactive popups based on data stored in the Site Owner's Wix database.


2. Eligibility & Wix Account Integration


2.1. Eligibility: To use this App, you must hold an active Wix account in good standing and possess the necessary authority to install applications on the target site.


2.2. Permissions: Upon installation, the App requests permissions to read relevant Wix CMS collections and display content inside your site's custom elements. You authorize the App to access and process such data solely for the purpose of operating the mapping functionality.


3. Plans, Subscriptions, and Billing


3.1. Free and Premium Tiers: The App offers both free-tier functionality and paid subscription tiers ("Pro" or "Premium") that unlock additional features (e.g., higher pin limits, marker clustering, advanced filters, custom map styling, and white-labeling).


3.2. Payment Processing: All billing, recurring subscription charges, upgrades, downgrades, and cancellations are managed directly through Wix Billing & Payment Systems. We do not collect or store your credit card or sensitive financial information.


3.3. Refunds: Subscription cancellations and refund requests are subject to the policies established by the Wix App Market.


4. Third-Party Services & Map Data


4.1. Mapping Engine: The App utilizes MapLibre GL JS, an open-source mapping engine.


4.2. Tile & Basemap Providers: Map tiles and geocoding services may be provided via public or third-party tile providers (such as OpenStreetMap contributors, Stadia Maps, MapTiler, or self-hosted servers). By using the App, you agree to comply with the attribution and fair-use guidelines of the respective tile and data providers.


4.3. Custom API Keys: no need for any keys.


5. User Content and Data Accuracy


5.1. Your Data: You retain full ownership of all data, addresses, coordinates, images, and text stored in your Wix CMS collections.


5.2. Accuracy & Legality: You represent and warrant that your content does not violate any third-party intellectual property rights, privacy rights, or applicable local and international laws.


5.3. No Liability for Coordinate Errors: We are not responsible for inaccurate map marker placement resulting from incorrect geocodes, invalid latitude/longitude entries, or misformatted addresses stored in your CMS.


6. Prohibited Uses


When using CMS Map & Store Locator, you agree NOT to:


  • Use the App for unlawful, fraudulent, defamatory, or harassing purposes.

  • Attempt to reverse engineer, decompile, or tamper with the underlying scripts, API calls, or custom element bundles of the App.

  • Circumvent, tamper with, or bypass pin quotas, usage limits, or license checks enforced by your subscription plan.

  • Abuse tile server bandwidth or deliberately generate excessive automated map requests intended to degrade service performance.


7. Intellectual Property


All software, visual design, custom element code, trademarks, icons, and documentation associated with CMS Map & Store Locator remain the exclusive intellectual property of TweakDesigns. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely on your authorized Wix websites.


8. Disclaimer of Warranties


THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE COMPLETELY UNINTERRUPTED, SECURE, OR FREE FROM TEMPORARY MAP TILE OUTAGES OR BROWSER RENDERING GLITCHES.


9. Limitation of Liability


TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL [YOUR COMPANY / DEVELOPER NAME], ITS DIRECTORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE APP DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.


10. Modifications to the Service and Terms


We reserve the right to modify or discontinue features of the App, or update these Terms periodically, to maintain compliance with Wix policies, legal requirements, or technical improvements. Continued use of the App following any posted updates constitutes acceptance of the revised Terms.


11. Termination


You may terminate this agreement at any time by simply uninstalling the App from your Wix site. We reserve the right to suspend or revoke access to the App if you violate these Terms or engage in activities that harm the platform, other users, or third-party infrastructure.
